BC Government Introduces Changes to Economic Development Projects on Federal Reserve Land

Last week the BC government introduced Bill 43, the FNCIDA Implementation Act, that will allow provincial laws and regulations to apply to major projects on federal First Nations Reserve Land.

The legislation allows BC to enter into agreements with the Government of Canada and First Nations to administer provincial laws on reserve lands for specific projects. Currently, two projects have been brought forward:

  • The proposed Liquefied Natural Gas (LNG) facility on a Haisla Nation reserve near Kitimat.
  • A proposed commercial and residential development on Squamish Nation reserve lands in the Lower Mainland.

Federally, the First Nations Commercial and Industrial Development Act (FNCIDA), which came into force in 2006, intended to close significant gaps in regulation on reserves and help facilitate economic development projects.

Without FNCIDA, any First Nation can proceed with developments on-reserve, without being subject to the same provincial regulations that apply to off-reserve developments. Bill 43, coupled with existing federal legislation, aims to fill regulatory gaps and apply provincial legislation to specified reserves, while attempting to provide greater certainty for investment capital and government regulation.

Province Amends Impaired Driving Law

The Province is introducing changes to the review process for immediate roadside prohibitions (IRPs) to address a BC Supreme Court ruling concerning the constitutionality of part of the existing IRP law. The proposed changes are designed to address the court’s concerns about providing drivers who fail a roadside breath-test a way to meaningfully challenge the results. Changes include:

  • Making it mandatory for police to advise drivers of their right to challenge the first test result by completing a second test.
  • Requiring police to advise drivers that the lower of the two readings will prevail.

Other amendments are designed to improve administrative fairness and provide drivers with the opportunity for a more rigorous review through the Office of the Superintendent of Motor Vehicles.
Last November, the Supreme Court found the current legislation infringes the Charter of Rights and Freedoms. The court granted government’s request that the declaration of unconstitutionality be suspended until June 30, 2012, to allow time to amend the law.

Staff Changes

  • Chad Pederson, Executive Director of the BC Liberal Party, has resigned effective the end of May to take a position with a nonprofit organization.
  • Jennifer Benoit, the BC Liberal Party’s Director of Communications, has resigned from her position with the Party.
  • Jim Rutkowski, a senior aide to Brian Topp in the recent federal NDP leadership, has joined the Victoria office of Hill + Knowlton Strategies.

Radium Pump Track Under Construction

 

  The CVCS work crew has been at work on the Radium Pump Track for a week   now and it is starting to take shape! About 60 dump truck loads of dirt have   been brought on site and a more will be added next week.

Feel free to visit the site and check out the hard work. You can even bring   your bike and get a little pump on trying out the completed portion of   the track. A junior loop has also been completed and is ready for youth   or those new to pumping. Riding a pump track is intense and a lot of fun.   You’ll be surprised how quickly it’ll get your breath going.

If you have a couple of volunteer hours here or there to help the work   crew that is also appreciated. The crew has been working weekdays   from about 9 a.m. to 5 p.m. If you have the time, please stop by during   these hours and lend a hand. For more information on volunteering   contact cvcyclingsociety@hotmail.com.

The Radium Pump Track is located to the north west of the four-way stop in   Radium. To get there park beside Rotary Park on Forsters Landing Road in   Radium. Take the footpath down to the Sinclair Creek Trails. The pump track   is right there.

The Radium Pump Track is a partnership between the Radium Rotary Club, the Village of Radium Hot Springs, and the Columbia Valley Cycling Society.

Planned Power Outage – May 27th

BC Hydro requires a planned outage on Sunday, May 27, from 5:30 a.m. – 9:00 a.m. MDT. The planned outage is required in daylight hours to safely install sky wires and complete upgrade work at the Athalmer Substation. The three and a half hour planned outage will affect approximately 6,600 customers in the Invermere and Radium areas. The specific areas affected will be provided to you and will also be detailed in local newspapers. We are taking all the necessary steps to minimize the inconvenience to our customers and will restore service safely and as quickly as possible. BC Hydro customers will be notified by advertisements in local newspapers and radio ads. Key account customers will be informed directly. Please forward this information to operations and planning departments within your organizations. is back for 2012 and we’re planning on making it a show that rocks the entire Columbia Valley!

Mark July 14, 2012 from 2:00 pm to 11:00 pm on your calendar.

The event is located on Coy’s Par 3 Driving Range and can accommodate up to 2000 attendees with plenty of room for parking and entertainment for all ages. The ‘Fun Zone’ will include a Lazer Tag Dome, bouncy houses, slide, face painting, crafts and magician. The adults will enjoy the line up of live entertainment throughout the day through until the end of the evening. Many vendors will be there to display their artistic talents, treats, beverages and great selection of food. Beer Garden will be on site with no alcohol permitted outside of  the fenced area.

To make this a Valley Event for everyone to talk about and contribute for years to come, we are in the process of looking for a recognizable band to Headline the show. This will attract out of town attendees and draw guests to the area for the entire weekend. Early Bird Tickets on sale for Steamboat Mountain Music Festival. Catch the juiciest worm! Until April 15th, a special best-buy early bird discount is offered

for tickets to the first Steamboat Mountain Music Festival which will be held on July 7th. The best buy cost is just $25 for adults and $10 for youths for a full day of music from

local and regional performers. After April 15th the cost climbs to $30 and $12.50 for a smaller early bird discount until June 7, and after that date it tops out at a still affordable

$35 and $15.

The line-up will include something for practically everyone. The music covers a range of styles and genres, age groups, and instrumentation. Many local Columbia Valley

musicians are involved, including: The Dry Gulch Ramblers, L8TE, Combo Akimbo, Marty and Eli Beingessner, Bob Benvenuti, and more. Two widely known regional

groups featured are John Reischman and the Jay Birds, and Maria in the Shower. The festival website lists all the performers that have been confirmed so far, with a few

additions still to come.

The festival’s concept is to feature local and regional talent in a full-day, affordable, family oriented outdoor festival. The festival site at Edgewater School is sheltered by

Steamboat Mountain and looks out on the beautiful Columbia River wetlands. With proceeds from this event, the organizers will establish a bursary/scholarship for aspiring

local musicians. Tickets are available on the website through a PayPal link (purchasers do not need to have a PayPal account but must print their receipt to claim their tickets at the gate).  Several local business outlets have also agreed to sell festival tickets on a cash only  basis:

2011 Certification issued via EcoStay Program

 Fairmont Hot Springs, B.C. –Friday, March 16, 2012 – Fairmont Hot Springs Resort has achieved ‘Carbon Neutral Status’ for 2011, purchasing sufficient offsets to balance off all the resorts’ operational emissions.

Dean Prentice, COO, says the resort joined the EcoStay program in December 2010. “Becoming certified as officially carbon neutral during our first year in the national EcoStay program is a great accomplishment for Fairmont Hot Springs Resort.  Carbon offsetting is an important part of our ongoing commitment to develop green and sustainable practices within the resort.”

EcoStay is a national initiative that helps hotels and resorts measure their carbon footprint, identify and fund reduction strategies and balance off their greenhouse gas emissions through carbon offsetting. Under the program, Fairmont Hot Springs Resort collects $2 per night from hotel guests. These funds are then used to purchase carbon offsets. $1.50 is used to purchase carbon offsets and 50¢ is used to make on-site and local eco-improvements.

Says Prentice, “The amount of carbon offset during 2011 is incredible. 1,647.8 tonnes of carbon offsets have been purchased from emission reducing projects. In real terms, that’s equivalent to taking 120,289 cars off the road for a day!”

Earlier this year, Fairmont Hot Springs Resort launched a new in-house eco-improvement initiative called Green Clean, funded though the project. “Green Clean is one more way our guests can help us conserve natural resources when they visit,” says Prentice. “Guests now have the option to decline housekeeping service for the day, and in return we reward them with a gift voucher to spend on dining.”

 All EcoStay Carbon Offset projects are registered on the Canadian Standards Association’s (CSA) GHG Clean Projects Registry to ensure proper reporting and independent verification.  Every offset project meets the strict requirements of ISO (International Organization for Standardization) or VCS (Verified Carbon Standard). The carbon offsets are supplied by LivClean, a top ranked carbon offset retailer by the David Suzuki Pembina Institute.
